Compliance with Royal Decree 159/2023

The Spanish Government has published new regulations to improve animal welfare on farms through Royal Decree 159/2023. This regulation is MANDATORY for every new farm built after its publication and MANDATORY from 8 March 2026 for all existing farms.

Regulated Environmental Conditions

Gas concentrations measured at the animals' head height must not continuously exceed the following limits:

  • 20 ppm for ammonia (NH₃).

  • 3,000 ppm for carbon dioxide (CO₂).

It is mandatory to have monthly monitoring records that reliably confirm the specified values are not exceeded.

Measures taken in the event these parameters are not met must be explicitly stated, both for gas levels and for temperature and humidity.

Porcine animal welfare regulatory update 📑

Under this new regulatory framework, pig farms are strictly classified into 3 distinct types.

Competitive advantage through sensorisation:

If you keep pigs with docked tails, the law allows you to **move from Type 3 to Type 2**, which dramatically improves the permitted stocking density from 0.74 to 0.68 m² per animal. This directly translates to a gain of approximately 1.5 pigs per pen.

To benefit from this, you must rigorously meet the technical requirements of Point A and simultaneously meet a minimum of 2 of the 5 requirements set out in Point B.

⚠️ The first two requirements of Point B strictly require a CO₂ sensor and a NH₃ sensor. With Augan technology, your farm meets this criterion immediately for inspection purposes.

Appeal ruling on RD 159/2023

The ruling on the administrative appeal is published. However, for practical purposes for farmers, this appeal has no real practical effect, as it directly challenges elements of the original wording of RD 159/23, which had already been structurally modified and corrected beforehand by the 10/10/2025 update via the new Royal Decree 809/2025. The sensor and monthly reporting requirements remain fully in force.
